Abstention

A bankruptcy court’s decision to decline to exercise jurisdiction over a matter before the court. With respect to certain matters, the bankruptcy court is required to decline to exercise jurisdiction. Such instances involve what is referred to as “mandatory abstention.” “Permissive abstention,” on the other hand, applies where a court has discretion whether to exercise jurisdiction.
