Patient Care Ombudsman

A “professional person” under 11 U.S.C. § 330(a)(1) who is to be appointed within 30 days after commencement of a health care business bankruptcy case to “monitor the quality of patient care and to represent the interests of the patients of the health care business,” unless the bankruptcy court finds the appointment is not necessary for the protection of patients under the specific facts of the case. An often discussed and rarely used tool in health care Chapter 11 cases.
