Competing Plan

A plan that is in competition with another plan filed in a debtor’s Chapter 11 case. A non-debtor proponent is required to wait until after the debtor’s period of exclusivity has expired before filing a competing plan. The competing plan can be an effective secured creditor tactic often superior to a stay relief motion.

Bankruptcy Code §§ 1121(c), 1129(c). See also Exclusivity Period.
