Intentionally Fraudulent Transfer

A transfer by the debtor of its property made with actual intent to hinder, delay, or defraud creditors. Fraudulent transfers occurring within two years prior to the bankruptcy filing are avoidable under Section 548 in bankruptcy cases filed on or after October 17, 2006 (or within one year in bankruptcy cases filed before October 17, 2006). State fraudulent transfer statutes are imported into the Code through Section 544. Those statutes usually have a longer look-back period (four years is common).
